Fifth MAC-EUPACT Pubblication
Published in the Class A journal Eurojus, the article “La prima attuazione del Patto sulla migrazione e l’asilo e i margini di intervento del legislatore nazionale. Riflessioni sul decreto-legge n. 100 del 2026” (The First Implementation of the EU Pact on Migration and Asylum and the Scope of National Legislative Discretion: Reflections on Decree-Law No. 100/2026) by Prof. Simone Marinai.
The article further develops the expert opinion submitted during the hearing before the Joint Committees on Constitutional Affairs and Justice of the Italian Senate on 25 June 2026. It examines the first national measures implementing the EU Pact on Migration and Asylum, with particular attention to the scope of discretion left to Member States, the protection of fundamental rights, and the balance between EU requirements and national legislative choices.
This publication represents the fifth scientific output developed within the framework of the Jean Monnet Module MAC-EUPACT.

Fourth MAC-EUPACT Publication
The fourth output developed within the framework of MAC-EUPACT has been published: “From Loss to Acquisition of Nationality: Union Citizenship and the (Still) Indeterminate Limits of State Competence” by Simone Marinai.
The article appears in Papers di Diritto Europeo, Special Issue, 2026, pp. 97-121.
The contribution analyses the evolving case law of the Court of Justice of the European Union concerning the relationship between national citizenship and Union citizenship. It examines the progressive limits imposed by EU law on Member States’ discretion in matters of nationality, with particular attention to the Commission v Malta judgment and the recent Italian reform of ius sanguinis. The article argues that, despite the growing constitutional relevance of Union citizenship, the limits to State competence in nationality matters remain only partially defined.
The contribution also forms part of the broader research carried out within MAC-EUPACT on the development of EU law, accountability, and the protection of individuals affected by migration and citizenship policies.

Third MAC-EUPACT Publication
The third output developed within the framework of MAC-EUPACT has been published: “Cittadinanza iure sanguinis e diritto dell’Unione: la Corte costituzionale e la riforma della cittadinanza italiana” by Simone Marinai.
The article appears in Eurojus, 2026, No. 2, anticipazione, pp. 1–19.
The contribution examines the recent judgment of the Italian Constitutional Court on the 2025 reform of Italian citizenship law (iure sanguinis), focusing on its relationship with EU citizenship and the limits imposed by European Union law on Member States’ competence in nationality matters. Particular attention is devoted to the principles of proportionality, effective judicial protection, and the interaction between national constitutional law and the case law of the Court of Justice of the European Union.
The article contributes to the broader reflection developed within MAC-EUPACT on the relationship between EU citizenship, migration, and the protection of fundamental rights.

Second MAC-EUPACT Output Published
The second output developed within the framework of MAC-EUPACT has been published: “La cittadinanza come strumento di integrazione” (Citizenship as a Tool for Integration) by Simone Marinai.
The chapter appears in V. Di Comite and I. Ingravallo (eds.), Quale inclusione per i migranti? Prospettive giuridiche multilivello, Cacucci, Bari, 2025, pp. 13–31.

The contribution explores the relationship between citizenship and integration, highlighting that the acquisition of citizenship does not automatically ensure effective inclusion, while integration processes may also develop beyond formal citizenship status.
